UK Terms and Conditions

Please read these rules carefully – BABY born Animated Series – Backpack Giveaway Promotion

These terms and conditions (“Terms”) apply to this BABY born Animated Series – Backpack Giveaway Promotion (“Promotion”). By taking part in the Promotion, you agree to be bound by these Terms. It is a condition of participation in the Promotion that all Terms are accepted as final.

This Promotion is organised by Zapf Creation (UK) Limited (“Zapf”). Our registered office is at Regent Business Park 50 Presley Way, Crownhill, Milton Keynes, Buckinghamshire, MK8 0ES. Zapf Creation (UK) Limited is registered in England and Wales under company number 03859936

You can participate in this Promotion through the website https://shop.zapfcreation.co.uk/baby-born/ (the ‘Website’). These Terms are additional to the website which continue to apply. If there is a conflict between these Terms and the website Terms and Conditions, these Terms will take priority to the extent necessary to resolve the conflict.

In the event of any dispute regarding the Terms or the conduct of this Promotion, the decision of Zapf shall be final and no correspondence or discussion shall be entered into.

This Promotion begins at 09:00 on the 18th of March 2024 and ends 23:59 on the 14^th April 2024, UK time (“Promotional Period”).

This Promotion is only valid in mainland England, Scotland and Wales. Regrettably, the Promotion is not valid in N Ireland, the Channels Islands, Isle of Man, Isle of Wight, Argyle and Bute, Orkney, Shetland Isles and Western Isles.

This Promotion cannot be used in conjunction with any other offer, promotion or voucher.

Participants in the Promotion must be at least 18 years of age (“Eligible Participants“).

Subject always to these Terms, Eligible Participants must purchase two or more eligible products from the promotional page during the Promotional Period in order to receive a free BABY born backpack (“promotional item”), subject to availability.

A full list of products included in the promotion are below. Only purchasing two or more of these items will trigger the BABY born backpack to be added free of charge to the basket.

The Promotional Item is suitable only for children aged three and over.

The Promotional Item will be posted to the Eligible Participant once the order is processed.

A limit of one Promotional Item per transaction applies to this Promotion. For the avoidance of doubt, if an Eligible Participant orders more than two eligible products, only one Promotional item will be added to the basket, in a single transaction, they would not be entitled to any more than one Promotional Item.

Zapf reserves the right to change the specification of any of the Promotional Items from those advertised.

There is no cash alternative to the Promotional Item. The Promotional Item is not exchangeable for cash or (subject to Term 25) for any other Zapf product or gift.

This Promotion is open to members of the public which can include employees of Zapf members of their families and households.

Returns and exchanges

Participants’ legal rights, including all rights in respect of refunds, replacements and repairs for products which are faulty, not fit for purpose or not as described, are unaffected by these Terms.

Other important terms

This Promotion is subject to stock availability. Whilst reasonable efforts have been made to ensure sufficient stocks are available to meet likely demand, Zapf may end the Promotion early (or suspend the availability of the Promotion) without notice if, in the opinion of Zapf, there is not sufficient stock to continue operating the Promotion.

If, in the opinion of Zapf, there is not sufficient stock of any of the Promotional Items, Zapf reserves the right in its sole discretion to substitute an alternative product as the Promotional Item.

Zapf reserves the right to cancel the Promotion or amend the Terms without notice in the event there is any actual or anticipated breach of any applicable law or regulation or any other event outside Zapf’s reasonable control.

Zapf reserves the right to not award a Promotional Item or to disqualify a participant if there are reasonable grounds to believe that any person is not eligible for any reason or for any other lawful reason, including failure to comply with these Terms.

Any attempt to deliberately undermine the legitimate operation of this Promotion may be a violation of criminal and/or civil laws and, should such an attempt be made, Zapf reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.

Data Protection

Zapf requires your name, email and address. We need your email in case we need to contact you regarding the Promotion. We need your address in order to post the Promotional Item to you.

Liability and Governing Law

Subject to Term 28, Zapf accepts no responsibility for any damage, loss, injury or disappointment suffered by any person as a result of their participation in this Promotion, their attempted participation or their acceptance of any product.

Nothing in these Terms shall exclude Zapf’s liability for death or personal injury as a result of its negligence, or for fraud or fraudulent misrepresentation, or for any other liability which may not be lawfully limited or excluded under English law. Further, nothing in these Terms shall affect any participant’s legal rights including in relation to any Zapf products.

Subject to Term 32 above, by participating or attempting to participate in this Promotion, participants agree that Zapf shall not bear any liability for:

(a) the loss, theft or misuse of any product; or

(b) any damage in any way attributable to this Promotion or the attempted participation in this Promotion.

This Promotion and these Terms will be governed by English law and any disputes shall be subject to the jurisdiction of the Courts of England and Wales.
